Who We Are
This Privacy Policy describes how Foros Law ("Foros Law," "we," "us," or "our"), the law practice of Yana Finkelstein, Esq., in Los Gatos, California, handles personal information collected through foroslaw.com (the "Site"). It applies only to the Site. It does not govern information we receive in the course of representing a client, which is protected by the attorney's professional duty of confidentiality described below.
Information We Collect
Information you choose to provide
When you complete the contact form on the Site, we collect the information you enter:
- your first and last name;
- your email address;
- your phone number, if you provide it;
- the type of matter you select; and
- anything you write in the message field.
If you email or call us, we receive the information contained in that communication, such as your email address, phone number, and whatever you choose to tell us.
Information collected automatically
Like most websites, the Site is delivered by a hosting provider whose servers automatically record basic technical information when your browser requests a page. This typically includes your IP address, browser type, operating system, the page requested, the referring page, and the date and time of the request. These records are used to deliver and secure the Site.
The Site loads its typefaces from Google Fonts, which means your browser requests font files from Google's servers and, in doing so, transmits your IP address and browser information to Google.
What we do not collect
The Site does not set cookies, does not use analytics or advertising tracking tools, and does not use social media tracking pixels. The link to our Facebook page is an ordinary link; Facebook receives information about you only if you click it and visit Facebook.
How We Use Information
We use the information described above to:
- respond to your inquiry and schedule a consultation;
- check for conflicts of interest and evaluate whether we can represent you;
- communicate with you about your matter if you become a client;
- operate, maintain, and protect the security of the Site; and
- comply with our legal and professional obligations, including record-keeping requirements that apply to attorneys.
We do not use your information to send marketing email, and we do not add you to any mailing list.
How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose personal information only:
- To service providers who help us operate the Site and our practice, namely Google (Firebase Hosting and Google Cloud), which hosts the Site and runs the code that receives contact form submissions; MongoDB Atlas, which stores contact form submissions; and Google Workspace, our email provider, which delivers each submission to us by email. These providers process the information on our behalf and only as needed to perform their services for us.
- With your direction or consent, for example when you ask us to coordinate with your accountant, financial advisor, or other counsel.
- When required by law, such as in response to a valid subpoena or court order, and then only to the extent permitted by our duties of confidentiality.
- To protect rights and safety, where disclosure is permitted by law and by the Rules of Professional Conduct.
Privacy and Confidentiality
Information you share with Foros Law about a legal matter is subject to obligations that go beyond this Privacy Policy. California law requires attorneys to maintain inviolate the confidence, and at every peril to themselves to preserve the secrets, of their clients (Business and Professions Code section 6068(e)). The California Rules of Professional Conduct also protect certain information shared by prospective clients who consult a lawyer about possible representation.
Even so, please do not send confidential details through the Site until we have confirmed that we can represent you. Our Disclaimer explains why.
Retention
We keep contact form submissions and related correspondence for as long as needed to respond to you, to maintain an accurate record for conflict-of-interest checks, and to meet our legal and professional record-keeping obligations. If you become a client, your information is retained in your client file in accordance with our file retention practices. Contact form submissions are stored in a database hosted by MongoDB Atlas in the United States, which encrypts data in transit and at rest. Hosting server logs are retained by our hosting provider according to its standard practices.
Security
The Site is served over an encrypted (HTTPS) connection, and we use reasonable administrative and technical measures to protect the information you send us. No method of transmission over the internet or of electronic storage is completely secure, however, and we cannot guarantee absolute security. Please call us if you would prefer not to send information electronically.
Your Choices
You may contact us at any time to ask what personal information we hold about you that was submitted through the Site, to correct it, or to ask that we delete it. We will honor reasonable requests, subject to our obligation to keep records needed for conflict checks and other records we are required to maintain by law or by the Rules of Professional Conduct. To make a request, use the contact details at the end of this policy.
Do Not Track
Some browsers can send a "Do Not Track" signal to websites. Because the Site does not track visitors over time or across other websites, and does not allow third parties to do so through the Site, it does not change its behavior in response to Do Not Track signals; your experience of the Site is the same either way. The only third parties that receive information when you visit the Site are our hosting provider and Google Fonts, as described above.
California Residents
Foros Law does not sell or share personal information, as those terms are defined in the California Consumer Privacy Act, and does not use or disclose sensitive personal information for purposes other than those described in this policy.
Under California Civil Code section 1798.83, California residents may ask whether a business has disclosed their personal information to third parties for those third parties' own direct marketing purposes. Foros Law does not make such disclosures.
Children
The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has submitted information to us, please contact us and we will delete it. Information about minor children that a parent or guardian provides as part of estate planning is handled as part of that representation.
Visitors Outside the United States
Foros Law is located in California, and the Site and our service providers operate in the United States. If you contact us from outside the United States, the information you provide will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
Changes to This Policy
We may update this Privacy Policy from time to time, for example if we change how the Site works or add new services to it. When we do, we will post the revised policy on this page and update the effective date at the top. If we make a material change in how we use personal information collected through the Site, we will note the change prominently on the Site.
