Acceptance of Terms

These Terms of Service ("Terms") govern your use of foroslaw.com (the "Site"), which is operated by Foros Law, the law practice of Yana Finkelstein, Esq., in Los Gatos, California ("Foros Law," "we," "us," or "our"). By using the Site, you agree to these Terms, together with our Privacy Policy and Disclaimer, which are part of these Terms. If you do not agree, please do not use the Site.

Informational Use Only

The content of the Site is provided for general informational purposes. It is not legal, tax, or financial advice and should not be relied on as such. Laws change, and the application of law depends on the specific facts of each situation. Before making any decision about your estate, your business, your taxes, or any other legal matter, you should consult an attorney about your circumstances.

Attorney-Client Relationship

Your use of the Site, including submitting the contact form, sending us an email, or calling our office, does not create an attorney-client relationship. Foros Law represents a client only after it has completed a conflict-of-interest check, agreed to undertake the representation, and entered into a written engagement agreement signed by both the client and Foros Law. Until then, Foros Law is not your attorney and has no obligation to act on your behalf, including with respect to any deadline that may apply to your matter.

Communications

Please do not send confidential or time-sensitive information through the Site or by email before Foros Law has confirmed in writing that it can represent you. Submitting an inquiry does not obligate Foros Law to respond within any particular time or to accept your matter. Communications sent over the internet may not be secure. See our Disclaimer for more detail.

Licensure and Jurisdiction

Yana Finkelstein is licensed to practice law in the State of California. Foros Law advises clients throughout California and the United States on California law and on federal tax law, and does not advise on the law of any other state. Where a matter requires advice on the law of another state or country, Foros Law works with counsel licensed in that jurisdiction. See the Disclaimer for details. The Site is not intended to solicit clients in any jurisdiction where doing so would not comply with local law.

Intellectual Property

The Site and its content, including its text, graphics, logos, design, and the Foros Law name and logo, are owned by or licensed to Foros Law and are protected by United States and international copyright, trademark, and other laws. You may view the Site and print or save a copy of individual pages for your own personal, noncommercial use. You may not otherwise copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written permission.

Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • submit false, misleading, or another person's information through the contact form;
  • send unsolicited advertising, spam, or harmful code through the Site;
  • attempt to gain unauthorized access to the Site, its servers, or any related systems, or interfere with the Site's operation; or
  • use automated means to scrape or collect content from the Site.

Links to Other Websites

The Site may contain links to websites operated by others, such as government resources or social media. These links are provided for convenience only. Foros Law does not control those websites and is not responsible for their content, accuracy, or privacy practices. A link does not imply endorsement.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Foros Law disclaims all warranties, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that the information on the Site is current.

Limitation of Liability

To the fullest extent permitted by law, Foros Law and its attorneys and staff will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or relating to your access to or use of, or inability to use, the Site or any information on it, or your reliance on that information. This limitation applies only to your use of the Site. It does not limit any obligation Foros Law owes to a client under a signed engagement agreement or under the Rules of Professional Conduct.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and changing the effective date above. Your continued use of the Site after a change is posted means you accept the revised Terms.

General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and Foros Law regarding your use of the Site. They do not govern any attorney-client relationship, which is governed solely by a written engagement agreement.
